Terms of Use

These Terms of Use ("Terms") govern your access to and use of burnwire.ai and any related pages or subdomains (collectively, the "Site"). The Site is operated by Burnwire, a California sole proprietorship owned and operated by William Nichols ("Burnwire", "we", "us", "our").

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, don't use the Site. If you're using the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

These Terms apply to your use of burnwire.ai as a visitor — reading pages, submitting the contact form, browsing case studies. They do not govern paid engagements between Burnwire and clients. Those relationships are governed by separate written agreements (MSAs, statements of work, or proposals signed by both parties).

If there's ever a conflict between these Terms and a signed engagement contract, the signed contract wins — for the scope of that engagement.

You may view and interact with the Site for lawful purposes. You agree not to:

• Attempt to probe, scan, or test the vulnerability of the Site or circumvent any security measure.
• Interfere with the operation of the Site, including flooding the contact form, launching denial-of-service attacks, or submitting malicious content.
• Scrape or harvest content, images, or contact information at scale, including for the purpose of training commercial AI models without prior written permission.
• Use the Site to transmit any unlawful, infringing, defamatory, or misleading material.
• Misrepresent your identity or affiliation when submitting the contact form.

We reserve the right to block access, remove submissions, or take other action if we reasonably believe you are violating these Terms.

All content on the Site — the Burnwire name and logo, written copy, design, visual identity, code, case study materials, and photographs — is owned by Burnwire or used with permission, and is protected by copyright, trademark, and other intellectual property laws.

You may view, share, and reference the Site for non-commercial purposes (linking to us, quoting short passages with attribution, taking a screenshot for a social post). You may not copy, republish, or build derivative works from substantial portions of the Site without written permission.

Client work showcased in case studies is published with the client's knowledge. Trademarks, logos, and screenshots of client products belong to their respective owners and are shown for illustrative purposes.

If you submit the contact form or email us, you represent that the information you provide is accurate and that you have the right to share it. You grant Burnwire a limited license to read, store, and respond to your message, and to retain a copy for our records.

Don't send us confidential, trade-secret, or sensitive personal information through the contact form. A project description is fine. A full customer database is not. If you need a confidentiality arrangement, ask — we'll sign an NDA before you share anything sensitive.

If you share ideas, feedback, or suggestions, you agree that we may use them without obligation or compensation. (We're happy to consider ideas — we just can't run a business where every suggestion creates a legal claim.)

The Site may link to third-party websites — case study URLs, client products, software tools. Those sites are independent of Burnwire, and we're not responsible for their content, privacy practices, or terms. Visit them at your own discretion.

We work hard to keep the Site accurate and functional, but we provide it "as is" and "as available," without warranties of any kind — express, implied, or statutory. That includes, without limitation, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We don't warrant that the Site will be uninterrupted, error-free, secure, or free of viruses. Content on the Site is general information about our services — it's not professional, legal, or engineering advice for your specific situation.

To the maximum extent permitted by law, Burnwire and its owner will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the Site — including lost profits, lost data, or business interruption — even if we've been advised of the possibility of such damages.

Our total aggregate liability for all claims arising from or related to the Site is limited to one hundred U.S. dollars ($100). Some jurisdictions don't allow certain limitations of liability; in those places, this limitation applies to the fullest extent allowed.

You agree to indemnify and hold harmless Burnwire and its owner from any claim, damage, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.

We may update these Terms from time to time. The "Effective" date at the top of this page reflects the current version. Material changes will be noted visibly on this page for a reasonable period. Your continued use of the Site after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be resolved in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.
